Death Penalty to be sought against Brokes

Prosecutors are now saying they'll seek the death penalty against a Hannibal man, accused of killing a woman in her Hannibal home in January, 2016. Scott Hardy has more.

Marion County Prosecuting Attorney David Clayton announced Tuesday afternoon that he and Monroe County Prosecuting Attorney Talley Kendrick would seek the death penalty against Timothy Brokes. He's accused of shooting Brittany Gauch in her home, after shooting Gauch's husband Aaron earlier the same night. Brokes also faces assault and armed criminal action charges in Monroe County, in the shooting of Monroe City police officer Travis Pugh the next night. In a statement, Clayton says the decision to seek the death penalty was made after consulting with the Missouri Attorney General’s Office, and after "additional information was learned over the course of the ongoing investigation of the defendant." Clayton alleges that Brokes killed Brittany Gauch, to prevent her from possibly testifying about the shooting of Aaron Gauch, and about Brokes's alleged meth dealing, of which she had first-hand knowledge. Clayton added that Brittany Gauch was shot to death in her home, in front of her two-year old son.

Brokes, who's being held in the Missouri State Prison in Fulton on a parole violation, will be back in court October 2. A court document outlining the prosecution's reasons for seeking the death penalty is available below.
