IL Appeals Court overturns ICC permission on Clean Line

Rules that ICC didn't have authority to rule.

The proposed Grain Belt Express power line has hit another delay, this time in Illinois.

Illinois's 5th District Appellate Court has overturned a 2015 ruling by the Illinois Commerce Commission that approved a request by Clean Line Energy Partners to build the high-voltage power line through several Illinois counties, including Pike and Scott. The court ruled the Commission didn't have the authority to grant the OK to a non-public utility. The court also ruled that Clean Line doesn’t meet the definition of a public utility. The company wants to build the line to bring wind-generated power from Kansas through Missouri and Illinois to Indiana.  

Clean Line can ask for a re-hearing from the Appellate Court, or ask the Illinois Supreme Court to take the case.
