Iowa AG says Deputy Dakota Foley "showed great restraint"

A Lee County Iowa Sheriff's Deputy has been cleared of any wrongdoing in the shooting of a suspect near Montrose last week. 

The Iowa Attorney General's Office issued a statement Thursday, clearing Lee County Deputy Dakota Foley in the shooting of Joshua Welborn. In its' statement, the AG's office said Foley "acted with great restraint and tried to resolve the tense situation peacefully before firing when necessary." In that incident, Lee County Deputy Dakota Foley fired his .40 caliber service revolver into Welborn's torso. The deputies encountered Welborn while he was allegedly in the act of burglarizing a home. In body-cam video released Thursday by the Sheriff's Department, Welborn is seen holding a hammer, and had blood dripping from his hand when he confronted Foley and his partner. Foley shot once, after Wellborn advanced toward the deputies with the hammer uplifted, as if to strike them. Wellborn was treated at an Iowa City hospital.

He's now in the Lee County Jail, and faces charges of First Degree Burglary, Second Degree Criminal Mischief, and Assault on a Peace Officer.
