Seth Emerson alleged to have shot dog Tuesday morning, bullet hit his younger brother

A Hannibal man, arrested after an argument early Tuesday morning where his 17-year old brother and a dog were both shot, has been formally charged.

Marion County Prosecuting Attorney David Clayton announced Tuesday afternoon that he's charged 19-year old Seth Emerson on counts of Felony Unlawful Use of Weapon and misdemeanor Animal Abuse. Emerson alleged to have shot a dog and the bullet then hit his brother Jason in the leg. Clayton says that Emerson was allegedly intoxicated at the time, and in Missouri, it's illegal for a person to fire a gun while intoxicated. Clayton says that the dog is recovering, and that he couldn't file a felony Animal Abuse charge because the dog wasn't tortured, and Emerson doesn't have a prior conviction for abuse. Emerson's in the Marion County jail awaiting bond to be set. His first court appearance will likely be via video on Friday.

If convicted on both counts, Emerson could get up to five years in prison.
