Deputy sues Adams County over 2020 crash

Deputy Javier Lofton filed suit Friday, saying the county hasn't acted on his post-accident claim

An Adams County Sheriff's deputy, injured in a 2020 vehicle crash while on the job, has sued Adams County and a state agency over its' failure to act on a claim he filed.

Deputy Javier Lofton filed the five-count suit Friday in Adams County Circuit Court against the County, the Counties of Illinois Risk Management Agency and underwriters at Lloyd's of London. The counts include breach of contract and fraud against the underwriters, the County and CIRMA. In the suit, Deputy Lofton says that in October 2020, he filed an Under-Insured Motorist claim with the county, and a demand for arbitration under a policy held by the County. He says he's still waiting for a response. Lofton was hurt in early July, 2020 during a traffic stop on Interstate 172. He and his patrol car were hit by a third vehicle, who according to the suit, was under-insured. Lofton says that as a result of the accident, he suffered injuries to his his right knee, left shoulder and right elbow. He aslo claims he now has over 108 thousand dollars in medical bills.

Lofton is asking for over $50,000 in damages, as well as court costs and punitive damages. The suit is available below.
