Motion to keep Ed Parkinson and David Robinson from testifying denied

Two special prosecutors who handled Curt Lovelace's re-trial on a murder charge will have to testify in his Federal civil suit.

Ed Parkinson and David Robinson with the State's Special Prosecutors' Office will have to testify in the civil suit filed by the former Adams County prosecutor. That's after a Federal judge denied a motion from the state of Illinois, that claimed they shouldn't have to testify. In his opinion, handed down Tuesday, Judge Tom Schanzle-Haskins agreed with the defense, saying that both Parkinson and Robinson "likely have discoverable information." Schanzle-Haskins went on, saying the two "clearly have discoverable information about (Quincy Police Department Detective Adam) Gibson's conduct." Lovelace's attorneys want to ask both men about emails from Gibson that were mentioned during the re-trial.

Lovelace filed an 11-count lawsuit in Federal District Court in Springfield in May, accusing the QPD of trying to frame him for murder in the death of his first wife Cory in 2006. He's also claiming that evidence used in the trials was fabricated and withheld from his defense. Lovelace, his wife Christine and their three sons are suing the City, the QPD, Gibson, Police Chief Rob Copley and three other officers, along with Adams County, State's Attorney Gary Farha and Coroner James Keller.

The civil trial is set for October 15th, 2019. The judge's full opinion is below.
