Suit dropped due to new state law raising award limit in Court of Claims
A civil suit, filed in Adams County by the family of a Lisle, Illinois man who died of Legionnaires' Disease in October 2017 at the Illinois Veterans Home in Quincy, will be dropped due to a new Illinois state law.
That's according to Steve Jambois, an attorney representing Mathew Dehn. Jambois says the suit's being dropped because the state of Illinois adopted a new law, raising the amount of damages that can be collected in similar suits filed in the state Court of Claims, from $100,000 to $2 million. Jambois says that the second suit in Adams County was filed because of the lower limit.

He adds that dropping the Adams County suit should speed up the family's suit against the state, and that it should be resolved in the next 12 months. A hearing in Adams County Circuit Court will be held Wednesday afternoon, where a motion to dismiss the suit against Blessing Hospital, Zorian Trusewych, the former medical director of the Vets Home and three others will be heard. Dehn had filed the suit in July, the same month he sued the state of Illinois. The suits were brought in connection with the October 2017 death of Dehn's father, 88-year old Valdemar "Roy" Dehn. He died of Legionnaires' Disease, 8 hours after tests confirmed he had it.
The Adams County suit alleged that Blessing and Trusewych failed to test Dehn for Legionnaires' throughout 2017, even after other residents tested positive.
